I certify that the information given by me in this application is true in all respects, and I agree that if the information given is found to be false in any way, or omitted in any way, it shall be considered sufficient reason for denial of employment or discharge. I authorize the use of any information in this application to verify my statements, and, unless indicated otherwise, I authorize the past employers, all references, and any other persons to answer all questions asked concerning my ability, character, reputation, and previous education or employment record. I release all such persons from any liability or damages on account of having furnished such information. I consent to such investigations as Quail Creek Golf and Country Club may make regarding driving records, law enforcement records, and my general background. I further understand that all applicable portions of this application must be completed or I will be ineligible for consideration for the position for which I am applying.

I understand that nothing contained in this employment application or in the granting of an interview or of a position of employment is intended to create an employment contract between Quail Creek Golf and Country Club and myself for either employment or for the providing of any benefits. No promises regarding employment have been made to me, and I understand that no promise or guarantee of employment for any specific length of time or under any specified circumstances shall be binding upon Quail Creek Golf and Country Club unless made in writing by or with the express written consent and authorization of the Board of Directors. If an employment relationship is established, I understand that I have the right to terminate my employment at any time and for any reason with or without advance notice and that Quail Creek Golf and Country Club retain the same rights.
I understand that, depending on the position applied for, prior to being offered employment with Quail Creek Golf and Country Club I may be requested to take an examination pertaining to skills or equipment operation. In the event I have a disability that will affect my ability to take the test, I will so inform Quail Creek Golf and Country Club prior to the administration of the test so that a reasonable accommodation can be made. Requested accommodations may include accessible testing sites, modified testing conditions, and accessible testing formats. Quail Creek Golf and Country Club reserves the right to require medical documentation concerning the need for the accommodation.

I understand that if employed the policies and rules that are issued by Quail Creek Golf and Country Club are not conditions of employment and that Quail Creek Golf and Country Club may revise policies or procedures, in whole or in part, unilaterally at any time. I understand that this application for employment will be considered for a period of 30 days from the date signed and that after that time I must re-apply if I wish to be considered for future employment opportunities.

Quail Creek Employees understand and agree that any claim, controversy or dispute arising out of or relating to an Employee’s employment, or termination thereof, will be decided in Oklahoma City, Oklahoma, in accordance with the rules for commercial arbitration of the American Arbitration Association. Such claims include but are not limited to those arising under Title VII of the Civil Rights Act of 1964, the Civil Rights Act of 1866, the Pregnancy Discrimination Act of 1978, the Equal Pay Act, the Civil Rights Act of 1991, the Age Discrimination in Employment Act and/or the Older Worker Benefit Protection Act of 1990, the Rehabilitation Act of 1973, the Americans With Disabilities Act, the Employee Retirement Income Security Act, the Uniformed Services Employment and Reemployment Rights Act, the Worker Adjustment and Retraining Act of 1988, the Fair Labor Standards Act, the Family and Medical Leave Act, the Occupational Health and Safety Act, and any other federal, state and/or municipal statutes, orders or regulations pertaining to labor, employment and/or Employee benefits.

Any arbitration undertaken pursuant to the Federal Arbitration Act, and the decision of the arbitrator, will be final, binding, and enforceable in any court of competent jurisdiction. As such, any arbitration under this policy shall be the exclusive means of resolving any dispute arising out of an Employee’s employment, and no other action can be brought by an Employee in any court or other forum. In resolving all disputes between the parties, the arbitrator will apply the laws of the State of Oklahoma. A party who unsuccessfully initiates arbitration will be liable for reasonable fees and costs of the defending party. Otherwise, including an outcome involving dual awards, the parties will pay their own fees and costs. Agreement to abide by this arbitration policy is a condition of each Employee’s employment with Quail Creek.
